الملخص: This research is a legal-democratic analysis of Smart Cities and a case study of Curitiba, capital of the state of Paraná, Brazil. The investigation is based on the hypothesis that intelligent urbanization does not rely exclusively on cutting-edge technology, but rather on humanized, inclusive planning grounded in human rights. By examining the weakening of nation-states and the resulting rise of cities as protagonists in the reconstruction of citizenship and democratic participation, the study seeks to understand whether the Smart City model is replicable in diverse contexts and whether it can serve as a path toward more just cities. The research adopts a qualitative and exploratory approach, combining literature review, document analysis, the study of urban indexes and rankings, on-site observations, and participation in specialized events. The work is divided into three chapters: the first analyses the role of cities in the face of the weakening of nation-states, highlighting their importance in ensuring human rights and promoting democracy; the second discusses the concept and evaluation parameters; the third presents the case study of Curitiba, addressing its urban, socioeconomic, and cultural characteristics, as well as a critical analysis of its Master Plan and public policies. The conclusion is that, when rooted in democratic principles and adapted to local realities, the Smart City model can become a viable and effective tool for promoting inclusion, sustainability, and citizen participation.
